Jana Gate has the right to make a reservation to modify and revise these Terms of Use, our Privacy Policy, our Buyer Policy, our Seller Policy, or any part of these policies from time to time in its sole discretion . Any modifications  Jana Gate  make shall be effective and effective immediately and shall be included in the Terms of Use, Privacy Policy, Buyer Policy, Seller Policy or any other policies of additional terms from time to time. At the moment of  any  changes  made, Jana Gate will make these modified terms available on the site and may attempt to notify you of them in other possible ways. Therefore, Jana Gate advises you to check the site regularly for any updates, as they may include important changes that affect your legal rights.

Use, copy, modify, reproduce, prepare derivative works, distribute,  license, sell, transfer, display, perform, transfer, publish or otherwise exploit the Website, Services or any Content except. What’s permitted by Jana Gate pursuant to this Agreement .

Trying to Attempt   an unauthorized access, disable it  or use any part of the Website and/or Services including user accounts in any way that could damage, discontinue, disable, hack or suspend our Services, communications networks or related systems or interfere with the use of any part post to our website and/or services.

 

Permission Granted by User:

You submit and warrant that you have the right to give to Jana Gate, its employees, directors, officers, agents and contractors a worldwide, non-exclusive, transferable, royalty-free, irrevocable  license with the right to sublicense, use, display, copy, modify, distribute, license, sell and transfer and publish, perform, transform, broadcast, broadcast and otherwise exploit User Generated Content on, through and through the Site and/or Service and in accordance with our Privacy Policy. Although this license is not exclusive, you agree that Jana Gate has the exclusive right to exercise this license to the extent of combining your content with content from other users for the purposes of creating or publishing a searchable database of reviews and labor market information.

You a know and agree that you are fully  responsible for all Content generated by you that you make available through the Website and/or Services. Accordingly, you warrant and agree that:

You are the only and exclusive owner of all Content generated by You , that You offer through the Website and/or the Services or You have all rights, consents, permissions and licenses necessary to grant Jana Gate the rights in such User Content that are set  in this Agreement.

Content afforded by you, or all that you post, upload, display, submit, or transmit from your Content, or Jana Gate’s use of your Content (or any part thereof) on, through, or by any means on the Website and/or Services, this

Does not infringes, misappropriates , or infringes a patent, copyright, trademark, trade secret, moral or other intellectual property right, or right of publicity or privacy and will not lead in a violation of any applicable laws or regulation’s .

 

User admissions:

Jana Gate has the reserve right to disqualify any seller/buyer who  goes in an  inappropriate behavior. However, Jana Gate does not make any warranties about the quality, safety or legality of any products, items or supplies listed on the site. Any legal claim relating to any product you purchase must be directed directly to the seller of that product. You release Jana Gate from any claims related to products sold through our services including defective products, false claims by the seller or products causing bodily injury. You also a know and agree that you will be responsible for doing your own research before purchasing any product by communicating with the seller directly. Jana Gate does not represent Content Posted by Users through the Services.

You a know and agree that Jana’s Gate

(a) does not recommend dealings with any specific seller,

 (b) does not represent or warrant anything relating to the sellers or the quality of the products they offer.

(c)does not charge any additional fee from any seller to identify it through Our Services (In accordance  with  the Sponsored Results Policy set forth below)

We may offer you more choices through a service (“Sponsored Results”) on the Site that will appear above the search results. Where Jana Jet gets additional fees from the sellers to provide the funded results. The service of the funded results that we provide in our services is not considered and should not be considered as a Recommendation  or recommendation  by Jana Gate to cooperate with a specific seller or purchase a specific product.

We do all our best  to provide you with accurate Content and we don’t offer any  warranty, representation or warranty, expressed or implied, regarding the accuracy, copyright compliances, legality, price, cost or suitability information of User Posted Content that you may access through Our services.

We will not be responsible or liable for any decision you or anyone  else  makes or any action you take in reliance on any such content. If you rely on any Content, you do so at your own risk. You release Jana Gate from all liability associated with such content. You also understand that Jana Gate does  not do user’s test  of our services and you release us from liability related to your interactions with other users.

You a know and agree that Jana Gate has  reserved right to change,  condense, or delete any content, including User Generated Content, on the Site that Jana Gate,  considered to be in violation of any other provision of these Terms of Use, or the Seller or the Buyer policies, our Privacy Policy, or this Agreement .

 

Terms of Payment:

You still responsible for paying the bills and all dues that you owe to Jana Jet. You are also solely responsible for the collection and/or payment of any taxes on purchases or sales you make through   our  Services . You shall   resolve  any  dispute between  you

 And  any  Seller  that may arise  from  any dealings under this Agreement  directly with Seller. You shall resolve any disputes between you and any Buyer that may arise from any dealings under this Agreement directly with Buyer.

Any fees that Jana Gate may impose on you, whether fees on the site and/or services, are payable immediately and are non-refundable  except in case where Jana Gate considers that the refund is justified and you notify Jana Gate within 24 hours from the date of payment . This refund policy does not apply at all times regardless of your decision to terminate your use, or our decision to terminated your use, or the malfunction you cause to our Site and/or the Service whether planned, incidental or intentional,   in any reason whatsoever. Jana Gate reserves the right to determine the prevailing final prices for any of the services provided and the method of payment through the site.

 

Intellectual Property Rights:

You a know and agree that all intellectual property rights in the Website and/or Services are the sole property of Jana Gate. These links are   only as a conveniences to you, and  doesn’t mean that Jana Gate endorses the content of third part  Websites nor the business practices of these other companies, and in no way is Jana Gate responsible for any materials, products or services of these external part .

These services may be available or you can go for it in connection with third part services and content (including advertisements ) that Jana Gate has no control over. WE DISCLAIM ALL SUCH WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW . We do not guarantee that you will be able to access or use the Site and/or the Services (whether directly or through third-party networks ) at the times or locations of your choosing.

Jana Gate won’t be liable for you to any indirect, incidental,  special, exemplary, punitive or consequentialist damages, including loss of profits, loss of data, personal injury or property damage related to or in connection with the misuse of the Site and/or or the Services, even if Jana Jet has been advised about possibility of such damages.

Jana Gate won’t be liable for any damages or losses arising from: a) your use of or reliance on the Websites and/or Services or your inability  to access or use the Website and/or Services; or b) any transaction or relationship between you and the seller/buyer or any third part , even if Jana Gate has been advised of the possibility of such damages. Because some states or jurisdiction’s do not allow the exclusion or the limitation of Liability for consequential or incidental damaged, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law in this Agreement.

Jana Gate shall not be responsible for delay or failure to perform resulting from  causes beyond the normal  control of Jana Gate. It’s not allowed for any reason and cases of Jana Gate’s liability as compensation for damages, losses or causes of the event exceeded the value of the services provided . You may use Jana  Gate's  services  to search for, list, buy, sell or cancel orders or any other portions of the Services as set  forth above, but you agree that we will not be liable to  canceled  unfulfilled orders or any injury’s resulting therefrom, or any OTHER INJURY ARISING FROM OR IN CONNECTION WITH THE USE OF THE WEBSITE AND/OR THE SERVICES. You also agree that” Jana Jet” has no responsibility or liability on you related to the items that you may receive from the seller.

 

Compensation:

You agree to defend, indemnify, hold  Jana Gate and its employees, contractors, officers, directors, agents, partners and other affiliates from any and all claims, demands, losses, liabilities and expenses, including attorneys’ fees, arising out of or related to

  • ) your use of the Website and/or the Services;
  • your breach or violation of any of the Terms of Use and this Agreement;
  1. c) Jana Gate's use of User Generated Content; or
  2. d) your violation of any rights of any third part, including third part sellers.

 

Liability Exemption:

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU  AGREE TO RELEASE JANA GATE FROM ANY AND ALL CLAIMS, DAMAGES OR LIABILITIES OF EACH KIND WITHOUT LIMITATION, WHETHER KNOWN OR UNKNOWN, SUSPECTED OR NOT SUSPECTED, disclosed or undisclosed, related to the Site and/or the Services, including

 (i) any disputes between you and the seller/buyer

(ii) any third part failures to comply with applicable law and/or these Terms of Use, and

 (iii) any conduct or speech of any another user, whether online or offline.

To communicate with Jana Gate, Jana Gate may send you information related to the website and/or other services or offers that may be interesting to you and them. You agree to receive these communications as part of using the Services. You can “stop out” of these communications at any time by sending an email to Info@janagate.com However, please note that Jana Gate will still send communications that are necessary to provide the Services to you, such as responding to a password or customer service request, and that you cannot cancel these contacts.

Jana’s Gate Dispute Resolution Systems

At the moment of a dispute with another user, we encourage the buyer or seller to contact the other part and try to resolve the dispute amicably . In the way Buyers and Sellers are unable to resolve a dispute relating to a transaction on our Website. They must either participate in Jana Gate’s dispute resolution system by sending an email to Info@janagate.com While Jana Gate  is not obligated to resolve any disputes, we may ,try in our vision to attempt to assist users in resolving their disputes based on our interpretation of our policies. By using Jana Gate’s dispute resolution system, you a know that Jana Gate may use your personal information to resolve disputes with other members. You release Jana Gate from any claims, demands and/or damages that may arise from disputes with other users.

 

Termination:

Jana Gate reserves the right to cancel, suspend and/or deactivate your account immediately, if there is any violation of this Agreement or other policies and terms posted on the Site or through the Services by you or someone else using your credentials, without any notices. . We may also terminate, suspend, or deactivate your account for any other reason, including prolonged inactivity. Jana Gate will not be liable to you or any third part for any termination, suspension or deactivation of your access to the Website and/or Services. In addition, you agree not to attempt to use the Site and/or the Services after any termination, suspension or cancellation of activity (noting that only when  account terminations as a result of prolonged inactivity may you be permitted and able  to create another account).

If you decide to terminate your access to the Services and deactivate or permanently delete your account, you may do so through your Account Settings. Termination  of your account, whether by you or us, will not affect the availability of any User Generated Content posted on Jana Gate prior to the date of account termination, and such information and data may continue to appear or exist on the Site or its system for any period of time after termination or cancellation. Notices will be deemed received and given within 12 hours of sending the email, notification, reminder or alert.

 

Identify Claims :

Waiver:

If, Jana Gate fails to maintain strict performance of any of your obligations or represents you under this Agreement, or if Jana Gate fails to exercise any of the Rights or remedies to which it is entitled under this Agreement, then this It does not constitute a waiver of these rights or remedies and does not relieve you of compliance with these obligations. The waiver by Jana Gate shall not constitute a waiver of any subsequent default..

 

Entire Agreement:

This Agreement and any additional terms, policies, rules and guidelines posted via the Site and/or Services, each of which is incorporated here in by reference, including the Privacy Policy and Additional Terms, constitutes the entire agreement between you and us, and supersedes all prior written and oral agreements.

 

Attribution :

You don’t have the right to assign, transfer or sublicense the terms of this Agreement to any person or third part without the prior written consent of Jana Gate, and any attempting to do so in violation of this section shall be null and void. You give your consent to Jana Gate to assign or transfer these Terms in whole or in part, including:

  1. A) a subsidiary or affiliate;
  2. b) gains from the equity, business or assets of Jana Gate

Stay:

In the way of termination of your Account and these Terms of Use,  either by you or us, any provision of these Terms of Use that logically extends beyond such termination  will continue in full force and effect to the fullest extent necessary to enforce any rights obtained or obligations incurred under these Terms of Use Convention.

 

The Possibility of Separations:

If any of the terms of this Agreement are determined by any competent authority to be invalid, illegal or otherwise unenforceable, that term, term or provision will be severed from the remaining terms, and the terms and conditions will remain  to the fullest extent permitted by  law.

 

Governing Law and Disputes:

This Agreement shall be governed and interpreted in accordance to the laws and regulations Of the Kingdom of Saudi Arabia. Any contractual or non-contractual disputes or claims that may arise between you and Jana Gate under these Terms of Use or our Privacy Policy shall be submitted to the Saudi  exclusive jurisdiction  courts and venue, with respect to any claims brought by either part.

The Site Is operated in the Kingdom of Saudi Arabia and is intended for Saudi users. Any of  use outside the Kingdom of Saudi Arabia is at the user’s own risk. Users are responsible for compliance with any local, state, or federal laws that apply to their use of the Site and/or Services.

Jana Gate provides this website and/or services in both English and Arabic, and may, but is not obligated to translate this website and provide services in any other language. However, the Arabic version defines your relationship with Jana Gate, and any conflict between the different versions will be resolved in favor of the Arabic version.
